A bit of history... How did Capulet Square end out in this surreal situation!?!?!

What is Capulet Square?

Capulet Square is an Estate complex in East London composed by 4 blocks: Bailey House, Wealden House, Shire House and Padstone House and 3 buildings with 104 Flats... a pretty big complex One of the key feature of the Estate is its location 1 min walk to the Brombley by Bow underground station The development was completed in 2006 and most of the owners bought the flats for investment reasons off-plan from the developer (Berkley). Most of leaseholders are not resident and a good part of them is resident abroad. These factors played a big role in what has happened at Capulet Square When the Freeholder - Fairhold Artemis- took over from the developer, they appointed Trinity Estates as the Building Manager. In an Estate over 100 flats it is a must to have a professional firm running the operations (including the service charge collection)

Trinity, the Rouge and the First-tier Tribunal

Back in early 2010s a burglary case happened in the Estate that together with a few (allegedly) small micro-criminal episodes created a sense of mistrust in the Building Manager (Trinity) from some leaseholders and this situation was exploit by the Rouge Director, the Rouge or the Rat for short. Back in 2013 The Rouge convinced some leaseholders (with the help of a letting agency that at that managed 40ish flats) that they had to go after Trinity to recover over paid service charges. To be noticed that at this point he was already not paying his... He collected some cash, raised the case at the Tribunal (FTT with a section 27 - aka: Service Charge reduction case) and because of his stupid behaviour in court, the applications whom he was leading ended out to pay the cost of the case (pretty unusual situation...). After waste people money and time, and arguing that they should have appealed people backed off and the case finished there. At this point, the Rat smelled that he could make some money out of the Estate and avoid paying his S/C so he engaged Urang (A professional building manager) and with their help he created the RTM (Right to Manage) company and through an application to the FTT (Section 24) the company got the right to manage the Estate from the Freeholder on behalf of the Leaseholders. The key point here is "The Right to Manage lets you and the other leaseholders take over certain management responsibilities from the landlord without having to prove bad management.". What this means is that The Rouge managed to collect the signature from the leaseholders (who didnt really understand the process) and simply apply to the tribunal. This is a fundamental point of confusion, THERE IS A TRIBUNAL CASE BUT IT IS SIMPLY AN APPLICATION TO GET THE RIGHT TO MANAGE

The beginning of the reign of terror of The Rouge

At this point the story really starts. The Rouge could start collecting the service charges on the back of the tribunal order and start controlling the bank account where this service charges were and are collected. This was the start of a total disaster for the Estate, with a single incompetent person in full command only partially controlled by Urang but impossible to stop on his pursue of stupidity. .... the story will continue in another post. Who is the Rouge?

The Rouge Director is a British citizen resident in Japan who has a leased property at Capulet Square. We are not clear idea on his background and or education (if any) what we know if that he claimed to be a recruiter consultant. As you can image with this curriculum the jump to become the only director and property manager of an estate in East London is bizarre to say the least. But let's stay on point. As we said previously he took control of the Estate by convincing a group of leaseholders that there was an estate to be saved and that he was the best candidate to do so. In reality he lied to them under the promise that an RTM would have been the voice of the leaseholders giving higher priority to their interests rather than the interest of the freeholder... this was a very big mistake!

The continuous fights at Capulet Square against the ex Rouge Director!

Another day another fight, the endless battle @Capulet Square We have decided to put some thoughts in writing as the fight against the reign of terror that a Rouge Director (aka the Rouge or the Rat) has created needs to have a single place where memories of the happenings are logged for future generation. In this blog we will put some thoughts, a bit of history, myth debunks and informations on what the new management at Capulet Square has tried (and is trying) to achieve that summarised in a few words: transparency, common sense and legality!
